We regularly represent parties in reported cases.  We recently successfully defended a healthcare employer in an unfair dismissal claim by a longstanding employee involved in misconduct and obtained a “fair dismissal”. One case which has established our reputation in this area is the landmark case of McGrath v Trintech Technologies Limited 2004 IEHC 342.  We represented the employee in his claim for compensation for psychological harm or illness ( “personal injury”) caused by stress in the workplace (amongst other claims) against his employer.  The judgment is the first case in Ireland to recognise that an employer owes an employee a duty of care to an employee not to cause him psychological injury by subjecting him to occupational stress.
