Employment & Industrial Relations

Employment law has become increasingly complex for businesses as a consequence of the introduction of a huge volume of legislation and regulations in Ireland and within the EU.

We provide a tailored service for businesses dealing with employment and industrial relations issues from start-up businesses to large employers with multiple unions.. We prepare user friendly policies and procedures for use by business  to guide you in a step by step process to achieve your aims and to effectively manage your employment relationships.  Acting for both employers and employees in all aspects of employment law on a daily basis in Sandyford and the surrounding Dublin area (Goatstown, Blackrock, Leopardstown and Stillorgan) we have a unique understanding of the methods and tactics used from both perspectives in employment disputes and litigation.

For individuals and trade union members we offer support and practical advice. Our team comprises highly regarded practitioners and mediators in employment and equality law. We regularly represent parties in reported cases.  We recently successfully defended a healthcare employer in an unfair dismissal claim by a longstanding employee involved in misconduct and obtained a “fair dismissal”. One case which has established our reputation in this area is the landmark case of McGrath v Trintech Technologies Limited 2004 IEHC 342.  We represented the employee in his claim for compensation for psychological harm or illness ( “personal injury”) caused by stress in the workplace (amongst other claims) against his employer.  The judgment is the first case in Ireland to recognise that an employer owes an employee a duty of care to an employee not to cause him psychological injury by subjecting him to occupational stress.

Some recent examples of cases we are involved in include:-

  • Representing employers and employees in unfair dismissal, discrimination and whistle-blowing claims in the Workplace Relations Commission
  • Advising on restructuring, buyouts of employee terms and conditions, outsourcing, disputes involving permanent staff and agency workers
  • Advising in connection with stress, bullying and harassment claims
  • Acting as independent expert investigator where fraud and serious misconduct alleged against an employee
  • Advising in potential/ actual redundancy situations
  • Drafting and advising on Compromise Agreements or Settlement Agreements
  • Advising on changes, disputes and the implications of the Industrial Relations Amendment Act 2015

If you require assistance in relation to any of the above please call us  for a free consultation or send us an email.  A member of our team will contact you within 2 hours of receipt of your email, if during office hours or the following morning.
