Amorys Solicitors always strive to push the boundaries and to achieve maximum benefit for our clients. One case which illustrates our first in class approach in this area is the landmark case of McGrath v Trintech Technologies Limited 2004 IEHC 342. We represented the employee/plaintiff in his claim for compensation for psychological harm or illness (“personal injury”) caused by stress in the workplace (amongst other claims) against his employer. The judgment was the first in Ireland to recognise that an employer owes an employee a duty of care to an employee not to cause him/her psychological injury by subjecting him/her to occupational stress. This is yet another example of the ability of our lawyers to obtain such a result. This was a groundbreaking decision that significantly altered and extended the legal duties of the employer and the legal rights of the employee.
